About - Swamy Publishers
SHRI P. Muthuswamy, who was an employee of P & T, was the Founder as well as the Chief Author of Swamy Publishers, which is still the most valuable and reputed publications on rules and regulations affecting Central Government employees. This organization which had a humble beginning sometime in 1955, has during the last 50 years grown in leaps and bounds and has attained great popularity and recognition. The books which Shri P. Muthuswamy wrote are now in great demand in all Central Government organizations and Public Undertakings. It would be no exaggeration to say that today there are no acts, rules or orders of significance issued by the Central Government in relation to civil employees which are not included in Swamy's Publications
Personal Traits:
Shri Muthuswamy was a great person, also a humanist and a philanthropist. He is known for his friendship and camaraderie with his associates and friends. In spite of his striking success, Mr. Muthuswamy has remained to his friends and erstwhile colleagues the same, Mr. Muthuswamy when they first met. Everyone had wondered at the deep compassion Mr. Muthuswamy had for the less fortunate. He was admired for his remarkable strength and resourcefulness in making sure everyone is cared for. Mr. Swamy belonged to the entire country and indeed to all humanity. He was a soul of simplicity and humility. His passing away moved us, but it was his values, his style of living, his magnanimous nature and his multifaceted personality that endeared him to all of us.
His early days:
Shri Muthuswamy was born in a lower middle class family on the 22nd June, 1920. He had a bright educational career and got his first class degree in Mathematics in 1940. He could not afford to continue his studies to the postgraduate level. Even to complete his graduate course his mother had to part with most of her jewellery.
Entry in P & T Department:
Immediately after graduation, he had to seek employment to support his family. In the Postal Circle Recruitment Competitive Examination he took in 1941, he secured a high rank and entered service as a Post Office Clerk on 1st August, 1941.
His early ambition:
Ever since he took the Competitive Examination, he had an urge to bring out guidebooks for the candidates seeking the postal clerical service. When he applied to the Postmaster-General, Madras , for permission to bring out such books, the Superintendent of Post Offices, through whom the application was to be sent, refused even to forward his application! Out of sheer frustration, he had to give up his hopes
His struggle for promotion:
He realized that his clerical status had its limitations in coming into contact with well-wishers who could recognize his talent and advise him. He also felt that the only way to prove himself was to appear for the Government examinations.
He took the examination for promotion as Post Office Accountant and passed out successfully in 1950. At the time Nizam State 's postal administration was taken over by the Union Government and there was police action, he was sent on deputation from Chennai Circle to a Head Post Office in the state. Simultaneously, he passed the All India Examination of P & T Accountants' Service and soon after was posted to the P & T Directorate, New Delhi .
His inspiration for publishing books:
As an Accountant in Delhi , he had an opportunity to conduct regular free classes for the benefit of his junior colleagues. He edited his lectures to the examinees in the form of cyclostyled notes and sold them at a nominal price on a no-profit basis to examinees in other cities as well. He found that the material supplied by him was immensely useful and that his presentation was received with great enthusiasm.
First Project:
Encouraged by this response, he decided to bring out his first publication Pension Rules Made Easy in October, 1957. He became heavily indebted in finding finance for this project and had to sell away even his wife's personal jewellery. He had to face a lot of problems in the initial stages due to lack of publicity
His perseverance:
He did not lose hope. He was confident that his book was worth its weight in gold. Whosoever had an opportunity to know about the book eagerly purchased it. In due course, this book gained popularity. With perseverance, he added three more books in 1958. By the end of that year, he became well known in many Central Government Offices across the country as a reliable instructor and interpreter in the field of Guidebooks for Service Rules
Patronage by Government:
This bold venture brought him harassment at the hands of his superior officers. His bosses even tried to take him to task under the “Conduct Rules” for bringing out such publications. It was a long battle between personal prejudices on the one hand and merit and justice on the other. Eventually the Ministries of Home Affairs and Finance recognized his talent in dealing with the subjects in an efficient as well as effective way.
Author's Reputation:
In due course, he added several titles which included numerous reference books recognized by the Government. The Ministry of Finance specially designated him as an Officer on Special Duty for about three years in the Department of Expenditure to assist them in the codification of rules. He had quite a few out-of-turn promotions in his career in the P & T Department and finally retired as Director, P & T Accounts and Finance Service in the year 1978.
Starting the Charitable Trust:
After a successful career under the Central Government and a renowned publishing business, he started a Charitable Trust in 1981. He diverted a substantial portion of the profits of his business to the Trust every year. The Trust was granting educational scholarships and financial assistance for marriages, medical treatment, etc., to the poor sections of the society.
The School Project:
For decades, he was receiving encomiums from his patrons who benefited from his publications. His publications, no doubt, helped the Government employees to achieve promotions in their career. He was, however, anxious to do something more for the coming generation and impart to them the tool which sharpened their wits, their understanding and activated their capacity to learn.
His personal experience and the constant reminder of what a good education does to an individual spurred him to divert his entire income to the cause of learning. He felt that the most tangible way of achieving this ambition was to establish a School which provides education of an excellent standard. This was the basis of starting the school.

Swamy's Personal Contributions:
Shri Muthuswamy donated his entire immovable property to the Trust for taking care of the land needed for the school project up to Class XII. He donated all his movable assets, bank balances and all his investments to the Charitable Trust to finance the construction of the School and to meet the requirements up to Class V. His beneficiaries, business associates and admirers have also helped his cause by donating their mite to strengthen his hands.
Shri Muthuswamy lived for the School and devoted his full attention to its healthy development and stabilization. In just five years, he was able to execute his idea of starting a school and completed building a landmark at Porur with two magnificent buildings and present it to the society.

Clarifications on Child Care Leave to Central Government Employees

Sub: Child Care Leave to Central Government employees - regarding The undersigned is directed to say that subsequent tu issue of this Department OM of even number dated 0710912010, this Department has been receiving references from various Departments, seeking clarifications. I'he doubts raised are clarified as under:-
1. Whether Earned Leave availed for any purpose can be converted into Child Care Leave? How should applications where the purpose of availing leave has been indicated as 'Urgent Work' but the applicant claims to have utilized the leave for taking care of the needs of the child, be treated?
A: Child Care Leave is sanctioned to women employees having minor children, for rearing or for looking after their needs like examination, sickness etc. Hence Earned Leabe availed specifically for this purpose only should be converted.
2. Whether all Earned Leave availed irrespective ol'number of days i.e. less than 15 days, and number of spells can be converted? In cases where the CCL spills over to the next year :for example days CCL 30 from 27thDecember), whether the Leave should be treated as one spell or two spells'?
A: No. As the instructions contained in thc OM dared 7.9.2010 has been given retrospective effect, all the conditions specified in the OM would have to be fulfilled for conversion of the Earned Leave into Child Care Leave. In cases where the leave spills over to thc next year, it may be treated as one spell against the year in which the leave commences.
3. Whether those who have availcd Child Gal-e Lea\.< iol-more than 3 spells with less than 15 days can avail further Child C31.e Leave for the remaining period of the current year'?
A: No. As per the OM of even number dated 7.9.2010, Child Care Leave inay not be granted in more than 3 spells. Hence CCL may not be allowed Inore than 3 tinles irrespective of the number of daya or times Child Care Leavc has been availcd earlier. Past cases may not be reopened.
4. Whether LTC can be availed during Child Care Leave?
A: LTC cannot be availed during Child Care Lcave as Child Care Leave is granted for the specific purpose of taking care of a minor child for rearing or for looking after any other needs of the child during examination, sickness etc.

Sub: Filling up of GDS Posts in Branch Post Offices-review of guideline regarding.
Sir/Madam,
Reference in invited to this Directorate letter No. even dated 14th Jul 2009 on the subject cited above which provided for the manner of filling up of GDS vacant posts in single handed branch offices and branch post offices having two or more hands.
2. Provisional appointment for a brief may be resorted to only on account of sudden death, dismissal, removal, put off duty, absorption against the departmental post of Gramin Dak Sevaks and unauthorized absence for long period in case regular arrangements cannot be made immediately.
3. In the case of posts falling vacant due to discharge form service of the GDS BPM or absorption of the GDS BPM on the regular departmental posts, efforts should first be made to fill up the posts by adjusting identified surplus GDS fulfilling the prescribed qualification & other prescribed conditions failing which action should be taken in advance to fill the vacant post of GDS BPM on a regular basis by following the prescribed procedure and following other conditions prescribed under letter No. 17-103/2007-GDS dated 14 Jul 2009. The list of all the GDS, category wise, due to be discharged from service in calendar year may also be displayed on the Department's website in the month January of each calendar year.

Subject: SCHEME FOR ENGAGEMENT OF GDS ON COMPASSIONATE
GROUNDS-MERIT POINTS AND PROCEDURE FOR SELECTION.
Sir/Madam,
To objective of the Scheme for engagement of Gramin Dak Sevaks on compassionate grounds is to engage dependent family member of a Gramin Dak Sevak dying in harness, thereby leaving his family in penury and without adequate means of livelihood.
2. Keeping in view the objective of the Scheme, the existing instructions relating to compassionate engagement have time and again been reviewed/modified/simplified so that the system finally derived at shall be more transparent, efficient and uniform in nature.
3. Currently, there is no laid down transparent criteria for adjudging degree of indigence of the GDS family while considering their cases for compassionate engagement. Therefore, a need is felt to lay down transparent criteria for considering a request for engagement on compassionate grounds by a Committee. A balanced and objective assessment of the financial condition of the family has to be made taking into consideration of his/her assets and liabilities, and all other relevant factors such as presence of an earning member, size of the family and the essential needs of the family including social obligations, etc. in order to assess the degree of indigence of all the
applicants to be considered for compassionate engagement. The Department of Personnel &Training has provided for limiting compassionate appointment of wards of departmental employees to 5% of the total vacancies and no such stipulation has been made for this purpose in respect of GDS. This, however, does not mean that all applicants are to be engaged as GDS on compassionate grounds in relaxation of normal and only the exceptional and deserving cases are to be considered for compassionate engagement as the scheme stipulates that compassionate engagement is to be given only in indigent and deserving cases.
4. The existing procedure has been reviewed in this Directorate and it has been decided by the competent authority that to achieve the objective of the scheme of the compassionate engagement and to ensure complete transparency, merits of the cases can be conveniently indicated by allocating points to the applicants based on various attributes. Accordingly, the Department has worked out a system of allocation of points to various attributes based on a hundred point scale as indicated in the tables below:-

5. The above system of weightage not only brings more objectivity to the method but also ensures complete transparency and uniformity in the selection process. The above method is being introduced for considering cases of compassionate engagement to the dependents of the GDS in the event of death of the bread winner. The cases which are more than five years old or having an earning members (s) in the family shall continue to be referred to this Directorate as hitherto before.
6. Shri RS Nataraja Murti Committee had recommended in Para 17.20.2 as under:- "Keeping the spirit of compassionate appointments as enunciated by the Nodal Ministry and also the ruling of the Hon'ble Supreme Court, there is need to provide compassionate appointment to the dependents of GDS in hard and deserving cases. The purpose would be served if the engagement of GDS on the division in a year. The vacancies may be computed separately for GDS BPM and other categories.
The period of consideration of deserving cases may be kept as three years. While considering the cases there need not be any relaxation in educational qualification for the post of BPM. In hard and deserving cases requiring relaxations of educational qualification, the engagement may be offered in other categories of GDS subject to the condition that the incumbent can satisfactorily discharge the duties assigned". While the intention behind the scheme of engagement of GDS on compassionate grounds is to allow engagement of GDS on compassionate ground in hard and deserving cases only and not in all cases, the recommended percentage is twice the percentage prescribed for regular Government employees. The above recommendations have been examined
in this Directorate and it has been decided to accept the same. However, in view of the
Department's plan to computerize the Branch Offices and to use hand held devices etc. besides the requirement of combination of duties in various circumstance, it all categories of Gramin Dak Sevaks including GDS BPM.
7. The number of vacancies and ceiling of 10% now being proposed may be calculated in the following manner:-
(a) The vacancies occurring in a calendar year age to be computed separately for the GDS BPM and other categories of GDS by their appointing authorities for each division well in advance. The appointing authorities while calculating the same shall take into account the vacancies that are likely to occur due to discharge of Gramin Dak Sevaks on attaining the age of 65 years for this purpose during the ensuing calendar year. However, the vacancies arisen due to absorption of Gramin Dak Sevaks in regular departmental posts and due to death occurring during the currency of the calendar year will be added to the vacancies occurring in the next calendar year for computation. The requisite information therefore needs to be compiled at all levels and finally sent to the Head of the Circle concerned by 30th Nov in advance along with cases complete in all
respect.
(b) Circle Relaxation Committee shall consider all cases and approve the same subject to guidelines on the subject and ceiling of 10% of the vacancies calculated separately for GDS BPM and other categories of GDS strictly on application of the Point System for determining the indigence. Cases prescribed to be sent to the Directorate more than 5 years old and cases in which one or more member is earning shall continue to be recommended as per existing provisions subject to this overall 10% limit to be applied on divisional basis.
(c) In units where on application of the ceiling percentage, the number of vacancies for consideration of cases for compassionate engagement works out less than 1 (not zero), one vacancy may be earmarked in that division/unit for compassionate engagement.
(d) This percentage of 10% shall only apply to cover cases of wards of deceased GDS and not to GDS acquiring disability during service defined in the persons with Disabilities Act, 1995. Section 47 of the Persons with Disabilities Act, 1995 provides that no establishment shall dispense with or reduce in rank an employee who acquires a disability during his service as also no promotion shall be denied to a person merely on the ground of his disability. In case a GDS acquires a disability during his service and is considered to be unsuitable for the GDS post he was holding, could be shifted to some other post with the same TRCA.
(e) Period of consideration of deserving cases is prescribed as three years i.e. in case where it is not possible to offer engagement of GDS on compassionate grounds due to the application of prescribed ceiling, the case may be considered by the CRC in the subsequent CRC meetings of the next two years to the maximum.
(f) No relaxation in educational qualification for the post of GDS BPM or any other category of GDS would be permissible.
The above instructions will be applicable for all the compassionate engagement case to be considered on or after 01.01.2011. These issues with the approval of Secretary Posts.
