Subject: Extension of Risk Allowance till 31.12.2011.

           The undersigned is directed to refer this Departments OM No.21012/01/2008-Estt.(AL) dated 19.07.2011 vide which payment of Risk Allowance was extended till 31.12.2011. Extension of Risk Allowance for a further period of six months beyond 31.12.2011 has been considered and it has been decided that Risk Allowance may be continued at the existing rates for a further period of six months upto 30.06.2012 or till such time Risk Insurance Scheme is implemented, whichever is earlier.

Notification

G.S.R.........(E), ---- In exercise of the powers conferred by the proviso to article 309 and clause (5) of article 148 of the Constitution, and after consultation with the Comptroller and Auditor General of India in relation to persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules further to amend the Central Civil Services (Classification, Control and Appeal) Rules, 1965, namely :-

1. (1) These rules may be called the Central Civil Services (Classification, Control and Appeal) Amendments Rules, 2011.

    (2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Central Civil Services (Classification, Control and Appeal) Rules, 1965, in rule 14- 

(a) in sub-rule (2) for the Explanation, the following Explanation shall be substituted, namely :-

"Explanation - (i) Where the disciplinary authority itself holds the inquiry, any reference in sub-rule (7) to sub-rule (20) and in sub-rule (22) to the inquiring authority shall be constituted as a reference to the disciplinary authority.

                             (ii) Where the disciplinary authority appoints a retired Government servant as inquiring authority, any reference in sub-rule (7) to sub-rule (20) and in sub-rule (22) shall include such authority",

(b) in sub-rule (5), after clause (c), the following Explanation shall be inserted, namely :-

"Explanation :- For the purpose of this rule, the expression 'Government servant' includes a person who has ceased to be in Government service".

Last date to avail the relaxation of travel by air on LTC to visit Jammu&Kashmir
 

The fantastic opportunity to travel by air with family members to visit Jammu&Kashmir will be ended on 17.6.2012 and the relaxation to travel by air with family members to visit North East Region area to avail upto 30.4.2012 only. There is no confirmation to further extension of the relaxation to travel by air to Jammu&Kashmir and NER to Central Government serving employees.

CCS(LTC) Rules, 1988-Relaxation for travel by air to visit J&K.

The undersigned is directed to refer to the 0M. of even number dated the 18.6.2010 and to state that the Ministry of Finance (Department of Expenditure) have clarified that the term ‘Entitled class” mentioned in para 1(u) of the above quoted O.M.refers to “Economy class” only. All LTC claims for travel by air may accordingly be restricted to LTC80 Economy class air fare of Air India from the date of issue of this Office Memorandum.

2. Past cases already settled will not be re-opened.

Regulation of journeys by private airlines while availing Leave Travel Concession to Jammu & Kashmir.

After issue of DOPT O.M. No.31011/2/2003-estt.(A) dated 18/6/2010 regarding relaxation for travel by air to visit J&K, clarifications have been sought by Government servants/various Ministries/Departments from time to time. The doubts raised by various authorities have now been clarified by Ministry of Finance (Department of Expenditure) as under:-

Point raised
1.Whether entitled officers can travel by Private airlines to J&K ? Clarification
Yes. Travel by private airlines is available to all the categories of Government employees including those entitled in travel by Air. Point raised 
2.Whether the restriction of LTC 80 fare of Air India will apply in these cases ? Clarification 
LTC 80 fare would apply to all cases including those entitled to travel by air irrespective of their airlines.

3.This issues in consultation with Ministry of Finance (Department of Expenditure) vide their I.D. No.821838/SO-E.IV/2010 dated 3rd August, 2010

CCS (LTC) Rules, 1988 – Relaxation for travel by air to visit J&K

The undersigned is directed to say that in relaxation of CCS(LTC) Rules. 1988, it has been decided by the Government to permit Government employees to travel by air to J&K as per the following scheme:-

(i) All officers/employees of Government of India will be allowed to avail LTC to visit J&K against conversion of one block of their Home Town LTC.

(ii) Officers/employees of Government of India entitled to travel by air can avail this LTC in their entitled class.

(iii) All other employees of Government of India can travel by air in economy class from Delhi and Amritsar to any place in J&K by any airlines subject to their entitlement being limited to LTC-80 fares of Air India. Journey from their place of posting up to Delhi/Amritsar will have to be undertaken as per their entitlement.

(iv) Restriction of air travel only by Air India on LTC to other places shall continue to remain in force.

(v) This scheme shall be effective from the date of issuance.

2. These orders shall be in operation for a period of two years from the date of issue of this O.M.

3. In their application to the staff serving in the Indian audit and Accounts Department, these orders issue on consultation with comptroller and Auditor General of India.

Study Leave for Fellowships offered by reputed Institutes

Subject : Study Leave for Fellowships offered by reputed Institutes -

             The feasibility of bringing more Fellowships under the purview of Study Leave, on the same terms and conditions as the Jawaharlal Nehru Memorial Fellowship (JNMF) has been under consideration of this Department for some time. On the basis of the inputs from various Departments/Ministries regarding fellowship offered by reputed Institutions and in consultation  with Department of Expenditure. it has been decided to include the Fellowships offered by (i) K .K. Birla Foundation, (ii) Indian Institutes of Management, (iii) Management Development Institute, Gorgaon and (iv) Lok Nayak Jayaprakash Narayan National Institute of Criminology & Forensic Science on the same terms as that of the fellowship offered by JNMF at present. The following terms will be offered to Central Government employees who are awarded the said fellowship in relaxation of Rule 51, 57 and 59 of Central Civil Services (Leave) Rules, 1972 :-

i)  They will be granted study leave for the entire period of the Fellowship:

ii) They will be entitled to the benefits admissible to them in accordance with the Fellowship and in addition, entitled to draw leave salary only (without allowance) equal to the pay that they drew while on duty with the Government immediately before proceeding on such leave. However, they  will be entitled to Dearness Allowance at the Central Government rates on the leave salary admissible lo them:

iii)  Where considered necessary, the official may be allowed during the period of the Fellowship, the continued use of the facility of the residential telephone officially allotted to him, subject to payment by him of the bills for the rental and call charges of the telephone.

2.  So for as persons serving in the Indian Audit & Accounts Departments are concerned, these orders are being issued after consultation with the C&AG of India.

3.       This order takes effect from the date of issue.
