Clarification on Interest Rates on Small Savings Schemes

Ministry of Finance has clarified that although the rate of interest on small savings schemes will be aligned every year with rates of Government securities of similar maturity, with suitable spread, the rates are fixed and not floating so far as individual investments except PPF are concerned. This is in response to news items appearing in certain sections of the Press that the interest rates on small saving schemes, revised by the Government w.e.f. 1.12.2011, are floating rates, which will undergo change according to fluctuations in the yield on the Government securities. 


It has been clarified that the rate prevailing at the time of investments will remain fixed and unchanged till the maturity of the investment. Any revisions in interest rates in subsequent years will only be applicable to the investments made in the relevant period. For instance, investment made in an instrument other than PPF on 1.12.2011 will remain valid till the maturity of that instrument, irrespective of revision of interest rate with effect from 1.4.2012. As regards PPF, the interest rate fixed every year will be applicable to all PPF accounts.

Govt sets eyes on Post Office Banks


The government's plan to tap into India's vast postal system to reach out to the unbanked population by utilising offices across the country as banks is expected to take some shape this year as the proposal has been sent to the Finance Ministry for its nod.
The idea that 1.55 lakh Post Offices could double up as banks is aimed at aiding the government's goal of financial inclusion, especially in rural areas. Once implemented, coverage of the country's banking network will increase three-fold in one stroke.
Around 90 per cent of the Post Office branches are in rural areas. In contrast, out of approximately 87,000 bank branches in the country, around 24,000 are in rural India.
India Post is the biggest postal network in the world, a major portion of which, about 1.4 lakh post offices, are located in rural India.
Although the idea has been around for a while, Communications Minister Kapil Sibal brought it centre-stage in July. However, before it takes shape, the Acts governing the banking and postal sectors will have to go through major amendments.

"Before applying for a banking licence, there are certain procedures that need to be completed. The work is in progress and the proposal has been submitted to the Ministry of Finance for its nod to go ahead," a government official privy to the  development said.
The year may witness quite a few amendments to the 113-year-old Post Office Act, which are aimed at opening up the sector.
The proposed amendments in The Indian Post Office Act, 1898, include recognising the services of private courier players and bringing them under the regulatory ambit. This will legalise 'forbidden services' like sending personal letters through private courier companies.
However, a lot needs to be done within the Department of Posts before reforms are implemented in the sector, as the industry is demanding that the services wing of the DoP should be a separate entity. This could be done along the lines of BSNL, which was hived-off from the Department of Telecom, industry players have said.
During 2011, Sibal made efforts to kick-off reforms in the sector, starting with India Post.
"After many years, we have seen government is ready to listen to industry. Minister (Sibal) has said that no policy decision will be made without taking views of industry. It's a highly welcome move, but DoP officials are still not ready to open up," said an industry representative.
Sibal had announced a 100-day agenda for revamping the DoP, especially its services. The agenda was designed around objectives assigned under the 11th Five-Year Plan (2007-12).
The agenda included provisions to facilitate round-the-clock transactions by customers through web portals, call centres, ATMs and other tools to modernise and enhance the operational and service efficiency of the government-run 'India Post'.
Sibal attempted to create an image of modernisation in India Post by launching an e-post office portal with an e-commerce section. He pushed India Post to build partnerships with private players for utilising its capacity. The effort did show some results.
In June, 2011, India Post partnered with apparel retail chain Fab India to provide its customers with the facility to ship their purchases to destinations they want from the store.
The DoP also partnered with state handloom centres to provide logistics services to craftsmen for both national and international destinations.
Built up over the years, its reach in the hinterland caught the government's attention as a tool to reach out to the masses under public programmes.
The year for the DoP began with a partnership with the UIDAI to deliver Aadhar numbers. In November, the UIDAI roped in TCIL to support India Post, which could not manage the work load in view of inadequate printing facilities at Kolkata and Delhi.
India Post was printing about 1.5 lakh Aadhaar cards a day, whereas the UIDAI enrollment was over 10 lakh residents daily in that month.
The DoP was also seen as good option to disseminate wages to people under the Mahatma Gandhi National Rural Employment Guarantee Act (MGNREGA). However, a lack of capacity and lax management posed questions over its service standards.
A parliamentary Standing Committee on the DoP found a huge gap between the wages disseminated by the DoP and the figures recorded by the Department of Rural development.
In 2009-10, the gaps in the data submitted by both departments widened to 13 lakh in terms of total MGNREGA worker accounts and over Rs 1,000 crore vis-a-vis the wages distributed.
During 2010-11, the DRD furnished the data one month later than the DoP. Upon examination, it was found there was a deviation of 29 lakh in respect of the number of accounts and about Rs 1,221 crore in respect of the amount disbursed vis-a-vis the DoP's figures, the Standing Committee said in its report.
Besides these glitches, a fund crunch left the DoP unable to address urgent and important requirements.
During the 11th Five-Year Plan, the DoP was allocated Rs 2,700 crore for technology upgradation of Post Offices. However, the Expenditure Finance Committee (EFC) restricted this to Rs 2,505.86 crore.
The final amount approved two years after commencement of the Plan was Rs 978 crore.
With immense potential and as possibly many hiccups on the way to realising them, 2012 will be the year to watch which way India's postal system goes.

Savings Banks Account Number Portability

Government working on savings banks account number portability 

Financial services secretary, DK Mittal has said that the government is working on savings banks account 
number portability. This comes at a time when the central bank, Reserve Bank of India has favoured looking into the matter once every account holder has a number issued by the Unique Identification Authority of India or UIDAI.Mittal, however, said that banks would have to work on identification code, know your customers (KYC) norms and core banking solution ( CBS) for implementing the savings bank account number portability. 

"We want to do it (savings a/c number portability). Right now there are some technical problems...we have identified them. We will overcome them soon," he said.

Earlier RBI's deputy governor KC Chakrabarty had also said that account number portability remains a challenge in terms of technology.. 

The move would help customers change banks, without the need of going through the KYC norms again. 

As of now there is no country which offers complete bank account number portability, though rudimentary form is available in some European countries such as Sweden. 

On the issue of capital infusion in state run banks, Mittal said that capital infusion in PSU banks would be completed by the end of this fiscal. "We will complete the process of bank recapitalisation by March 31," he said. the government has made budget provision of Rs 6,000 crore for capital infusion in PSU banks in the current fiscal.

Casual workers were also entitled to Paid maternity leave: HC - Chennai


The Madras High Court judge said that as per Section 5(2) of the Maternity Act, women employees who had rendered more than 80 days of service during 12 months immediately precedingthe date of expected child delivery were entitled to 12 weeks of maternity leave with wages.
Chennai, Jan 03, 2012. (PTI) :  Stating that casual workers were also entitled to three-month’s paidmaternity leave if they had worked for 80 days in 12 months preceding child birth, the Madras High Court today told the state government to regularise services of a woman who was denied leave and job byauthorities.
Passing orders on a writ petition filed by L Kannaki, who was denied maternity leave, not allowed to re-join duty and then refused regularisation of her job, Justice D Hariparanthaman said “Kannaki was unjustly denied maternity leave and employment when she reported to duty after delivery. The action of the authorities is totally illegal.”

The woman was working as a casual labourer at Exotic Cattle Breeding Farm under the Department of Animal Husbandry in Thanjavur district since 1988. Since 1993 the government had regularised services of hundreds of casual labourers there.
When in 1996 Kannaki became pregnant and requested for maternity leave, officials told her that she was not entitled for maternity leave being a casual worker. After her child was born in September 1996, she reported for duty. Theauthorities, however, refused to provide her employment. 
She kept sending several requests and reminders seeking reinstatement and regularization of her services.
In 1999 though the Tamil Nadu Administrative Tribunal directed the department to reconsider its decision to deny her employment, her claim for reinstatement and regularization was rejected in an August 23, 2000 order.
Citing legal precedents supporting claims of Kannaki and slamming theauthorities for their abject refusal, the judge said that as per Section 5(2) of the Maternity Act, women employees who had rendered more than 80 days of service during 12 months immediately preceding the date of expected child delivery were entitled to 12 weeks of maternity leave with wages.
Rejecting the claim that if a job break was over 90 days, a casual employee could not be reinstated without consulting the employment exchange, the judge said the break in service was due to pregnancy and it had been proved by certificates and documents to prove that she delivered a male baby in September 1996.
The court directed the department to reinstate Kannaki within two months and regularise her job, besides paying her all monetary benefits from the date of regularisation.

Book Your Train Reservation Ticket While on Move through Mobile Phone
No Need to Carry Ticket Print-Out, Mere Display of Message on Mobile is Sufficient during Travel

To bring further convenience to the rail users, Indian Railways through Indian Railway Catering & Tourism Corporation (IRCTC), a Public Sector Undertaking under the Ministry of Railway, has been offering the service of booking e-ticket over the mobile phone. After initial registration and downloading of suitable software on the mobile handset with internet facility, it will be quite easy for the mobile users to book a reserve ticket through their own mobile. After booking, the passenger will receive a reservation message with full details of the ticket including PNR, Train No, date of journey, class etc. This virtual message would be treated at par with the print-out of the e-ticket which at present is taken out by the passengers and is known as Electronic Reservation Slip (ERS).  Hence, with the virtual message, passengers would not be required to take a print-out of e-ticket to be carried with them. Showing the reservation message of the confirmed ticket on their mobile during travel will be sufficient. The detail procedure of booking through mobile which is also available on the IRCTC website namely www.irctc.co.in,   is as follows:-


·        Indian Railway Catering & Tourism Corporation (IRCTC) offers the service of booking electronic ticket (e-ticket) over the mobile to rail users.
·        IRCTC’s Mobile Rail Ticket booking services are based on the webservicesmodel developed by IRCTC in order to enable the users of Mobile Phones to access the web based rail ticket reservation and enquiry services similar to www.irctc.co.in.
·        Application software has to be downloaded on to the mobile handset.  This software is provided by the respective service provider firms viz., NGPAY, PAYMATE and ATOM. The application can be downloaded from IRCTC website and also from various associates of IRCTC viz. NGPAY, ATOM, Paymate.  IRCTC is also likely to launch its mobile application shortly and the software will be downloadable from www.irctc.co.in.
·        These mobile applications are functional on most of the GPRS/Browser based mobile phones, from basic model to high end ones.
·        Internet is required on mobile phones to book tickets through mobile.
·        The Passenger has to register at the time of first transaction and thereafter book the ticket using his ID and password.
·        Whenever a passenger books a reserved ticket through Mobile phone, he will receive a message with full details of the ticket including PNR, Train No., date of journey, class, etc.  This virtual message would be treated at par with the print-out of the e-ticket which at present is taken out by the passengers and is known as Electronic Reservation Slip (ERS).  Hence, with this virtual message, passengers would not be required to have a printer with them to take a print-out of e-ticket to be carried with them.
·        The customer is charged ticket fare, IRCTC service charge and Agent service charge (Rs.10/- & Rs.20/- as per class of tickets) and applicable payment gateway charges.
·        The Service Charge is similar to e-tickets Rs.10/- for SL class and Rs.20/- for other higher class.
·        All the rules applicable to e-tickets are also applicable to the reserved tickets booked through Mobile phones except that in this case, the passenger can also show the virtual message received on mobile instead of carrying ERS.
·        More than a thousand users presently are availing this facility everyday.
